Terms of Service

Please read these Terms carefully before using Portloft. They govern your access to and use of the Service. By using Portloft, you agree to be bound by them.

1. Acceptance of Terms

By creating an account or using Portloft in any way, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Portloft.

These Terms apply to all visitors, users, and others who access or use the Service. "Service" refers to the Portloft platform, including the website at portloft.com, all subdomains, and any related APIs or tools.

2. Description of Service

Portloft is a portfolio hosting platform that allows freelancers and creative professionals to build and publish personal portfolio websites. Depending on your subscription plan, features include portfolio pages hosted at username.portloft.com, custom domain support, project and media management, and theme selection.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. Accounts

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@portloft.com if you suspect any unauthorised use of your account.

You may not use another person's account without permission. Accounts are not transferable.

We reserve the right to terminate accounts at our discretion, including accounts that violate these Terms or remain inactive for an extended period.

4. Acceptable Use

You agree not to use the Service to:

  • Upload, post, or transmit any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable
  • Infringe any intellectual property rights, including copyright, trademark, or trade secrets belonging to others
  • Upload malware, viruses, or any other malicious code
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Use the Service to send unsolicited communications (spam)
  • Scrape or harvest data from the Service without our written consent
  • Impersonate another person or entity, or misrepresent your affiliation with any person or entity
  • Engage in any activity that disrupts, degrades, or interferes with the performance of the Service

We reserve the right to remove any content and suspend or terminate any account that violates these rules, at our sole discretion.

5. Your Content

You retain full ownership of all content you upload to Portloft — including project images, descriptions, and profile information ("Your Content"). By uploading content, you grant Portloft a non-exclusive, royalty-free, worldwide licence to host, store, display, and reproduce Your Content solely for the purpose of providing the Service.

You represent and warrant that you own or have the necessary rights to all content you upload, and that Your Content does not violate any third-party rights or applicable laws.

We do not sell Your Content to third parties. We may use aggregated, anonymised usage data for service improvement and analytics.

If you delete your account, we will delete Your Content within 30 days, except where we are required to retain it by law.

6. Subscriptions & Billing

Portloft offers a free tier and paid subscription plans ("Launch" and "Pro"). Paid plans are billed on a monthly or annual basis depending on the option you select at checkout.

All payments are processed securely by Stripe. By providing payment information, you authorise Portloft to charge your payment method for the applicable subscription fees on a recurring basis.

Subscription fees are charged in advance. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.

We reserve the right to change subscription pricing with at least 30 days' notice. Price changes will take effect at the start of your next billing period.

All prices are listed in US dollars (USD) and exclude any applicable taxes, including Canadian federal GST/HST and any provincial or local taxes, which are your responsibility.

7. Cancellation & Refunds

You may cancel your subscription at any time through your account dashboard or by contacting us at hello@portloft.com. Cancellation takes effect at the end of your current billing period — you retain access to paid features until that date.

We do not offer refunds for partial billing periods. If you cancel an annual plan, you will retain access through the end of the annual period for which you have paid.

We reserve the right to issue refunds at our discretion in exceptional circumstances. Contact us if you believe you are entitled to one.

If we terminate your account due to a breach of these Terms, no refund will be issued.

8. Custom Domains

Pro plan subscribers may connect a custom domain to their Portloft portfolio. You are solely responsible for registering, maintaining, and paying for your custom domain with your domain registrar.

Portloft provides DNS configuration instructions for CNAME setup. We are not responsible for any issues arising from your domain registrar's services or DNS propagation delays.

If your Pro subscription lapses, your custom domain will stop resolving to your Portloft portfolio. Your portfolio will remain accessible at username.portloft.com on applicable plans.

9. Intellectual Property

The Portloft platform, including its themes, design, codebase, and branding, is owned by Portloft and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

The "Portloft" name, logo, and tagline are trademarks of Portloft. Nothing in these Terms grants you any right to use our trademarks.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

Portloft is subject to the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Canadian federal privacy law. We are committed to handling your personal information in accordance with these obligations.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for any data loss, and we recommend you maintain your own backups of any content you upload.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PORTLOFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO PORTLOFT IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

13. Indemnification

You agree to indemnify, defend, and hold harmless Portloft and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or related to your use of the Service or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the federal courts of Canada. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

If you are accessing the Service from outside Canada, you do so at your own risk and are responsible for compliance with the laws of your local jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. If the changes are material, we will notify you via email or a prominent notice in the dashboard.

Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
